Authorized Economic Operator (AEO)

AEO T2 &T3
  1. Review: Preparedness & OSPCA
    • Understand the operations undertaken by the Company, process flow (documents/goods) & review sample documents from the perspective of AEO T-2 & AEO T-3, Customs law, and Foreign Trade Policy compliances matters. This review would be for preparedness of:
      1. Determination of eligibility in respect of AEO T-3
      2. Process flows, compliances namely legal compliances, financial solvency, managing of transport & commercial records, safety, security of the business in terms soundness of internal controls, procedural security of transportation, handling/storage of cargo, related documentation, cargo security and other aspects as laid down in Circular, etc
      3. OSPCA: Collate documents as per OSPCA guidelines, such as import/export invoices, BoE/SB, licenses, ledgers, financials), etc to review the information/documents for following aspects:
        • Appropriateness of classification of import/export goods (broad level)
        • Valuation of imported goods: change in circumstances (import form related parties), implications of royalty, technical know-how etc.
        • Rate of duty including appropriateness of exemptions availed if any including fulfilment of conditions therein
        • Export/import incentives claimed
        • Customs procedures including licensing requirement (such as BIS, SCOMET, etc.)
        • Assessments (whether provisional, open bonds etc)
        • Evaluation of internal controls to ascertain as to whether the process controls are appropriate, etc
    • Share a draft report to the Company stating our understanding, documents reviewed, our observations from relevant legal compliance perspective and suggest way forward for best compliance practises in this area
  2. Assistance in obtaining AEO T-3 certificate
    • Based on review of documents and Customs processes, assist in preparation of application form (Annexure A to the Circular) and other Annexures
    • Submission of requisite application with AEO Authorities
    • Reply to queries raised by authorities, if any
    • Timely follow up with Authorities for faster disposal of the application including scheduling visit, if required
    • Represent the Company before Customs Authorities (restricted to AEO process) & obtain AEO T-2/T-3 certificate on best effort basis 6. Suggesting best compliance practices from AEO T-3 perspective
